By logging in, creating an account, or using any part of the LimeFiber system, you acknowledge that you have read, understood, and accepted these terms in their entirety. Your continued use of the system constitutes a legally binding agreement between you and LimeFiber Solutions, a duly registered Internet Service Provider in Kenya, hereinafter referred to as "LimeFiber" or "the Company."
The LimeFiber platform has been developed to provide customers, agents, and authorized users with a seamless digital experience for managing internet services. The system enables users to register accounts, renew subscriptions, view invoices, make secure payments, communicate directly with support representatives through the WhatsApp API integration, and access a range of other service management tools. The platform operates under a framework of lawful use, responsible communication, and adherence to applicable regulations including the Data Protection Act, 2019 and the Kenya Information and Communications Act.
To access or use the LimeFiber system, users must be at least eighteen years old or possess the legal capacity to enter into a binding contract under Kenyan law. During the registration or login process, users are required to provide accurate and up-to-date information including full name, contact details, and any other information reasonably requested by LimeFiber. The company relies on the authenticity of the information provided and shall not be liable for losses, delays, or damages arising from incomplete or false data. Users are solely responsible for maintaining the confidentiality of their login credentials including usernames, passwords, and one-time passcodes. Any unauthorized access to your account must be reported immediately to LimeFiber through official communication channels.
Access to the LimeFiber system is granted solely for lawful purposes and legitimate business or service-related activities. Users agree not to use the system in any manner that is illegal, deceptive, or detrimental to LimeFiber or its customers. Activities that disrupt, interfere with, or compromise the security or performance of the system are strictly prohibited. It is forbidden to attempt to gain unauthorized access to any part of the system, to reverse-engineer, replicate, or tamper with its code, or to use the system in a manner intended to cause harm or extract data unlawfully. Violation of these conditions may lead to immediate termination of access and may expose the offender to civil and criminal liability under Kenyan law.
LimeFiber Solutions places the highest importance on privacy and the responsible handling of user information. During the provision of services, the company may collect personal and technical data including your name, contact details, service location, payment records, and communication history. This information is collected for legitimate business purposes such as account management, billing, troubleshooting, technical support, and improving service delivery. LimeFiber complies fully with the Data Protection Act, 2019 and ensures that all personal data is processed lawfully, stored securely, and only retained for as long as necessary for service provision. Your information shall not be disclosed to third parties except when required by law, when you have given explicit consent, or when such disclosure is necessary to deliver a contracted service such as payment processing or system maintenance.
The LimeFiber web system is integrated with WhatsApp API to facilitate real-time communication between the company and its customers. By using the LimeFiber system, you consent to receiving messages, alerts, service updates, and support responses via WhatsApp. LimeFiber ensures that all communications through this integration are professional, relevant, and compliant with WhatsApp Business policies. The company does not share customer data with WhatsApp or any third party beyond what is necessary for legitimate operational use. Customers are encouraged to use this channel responsibly and refrain from sending abusive, offensive, or unlawful content. Any misuse of the communication feature may result in suspension or termination of service access.
LimeFiber provides convenient digital tools for managing payments and renewals through the web platform. Users must ensure that all payments are made exclusively through official LimeFiber payment channels as displayed on the system or communicated through verified correspondence from the company. LimeFiber shall not be responsible for any loss or damages resulting from payments made to unauthorized parties or through fraudulent links. Subscription renewals are processed based on current service rates, and customers are encouraged to ensure timely renewal to avoid service interruptions. Refunds, cancellations, and adjustments shall be handled in accordance with the company's internal billing policies and applicable consumer protection laws.
All materials, designs, trademarks, software, and technical systems within the LimeFiber platform are the exclusive intellectual property of LimeFiber Solutions. Users acknowledge that the platform, including all visual and functional components, is protected under intellectual property laws. No user may copy, reproduce, distribute, alter, or create derivative works from any part of the LimeFiber system without prior written permission. Any unauthorized use, duplication, or modification constitutes a violation of intellectual property rights and may lead to legal action under Kenyan and international law.
LimeFiber Solutions strives to ensure uninterrupted, secure, and efficient access to its online systems. However, due to the nature of digital and internet-based infrastructure, occasional downtime may occur due to system upgrades, scheduled maintenance, power outages, or network disturbances. LimeFiber shall take all reasonable measures to restore normal operation promptly but shall not be held responsible for any loss or inconvenience caused by temporary unavailability or technical failures beyond its control. The company reserves the right to improve or modify its systems from time to time to enhance functionality or comply with legal and technological developments.
To the maximum extent permitted by law, LimeFiber Solutions, its directors, employees, and affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use or inability to use the system. This includes, without limitation, loss of income, loss of data, interruption of service, or reputational harm. LimeFiber's total liability for any claim arising out of or relating to these Terms shall not exceed the amount paid by the user for the service giving rise to such a claim. This limitation shall apply irrespective of the cause of action, whether in contract, tort, or otherwise.
LimeFiber reserves the right to suspend, restrict, or permanently terminate user access to its system if there is reason to believe that a user has violated these Terms, engaged in fraudulent activity, or compromised the integrity of the platform. The company may also restrict access where required by law, regulatory order, or system security considerations. In cases of termination, users may lose access to stored data or communication history. LimeFiber retains discretion to reinstate access upon satisfactory resolution of the issue or upon appeal.
LimeFiber Solutions may revise or update these Terms of Service from time to time to reflect operational, legal, or technological changes. Any updates shall take effect upon publication on the LimeFiber website or communication through official channels such as email or WhatsApp. Users are encouraged to review these Terms periodically to remain informed of their rights and obligations. Continued use of the LimeFiber system after the effective date of any update shall constitute acceptance of the revised Terms.
These Terms of Service are governed by and shall be construed in accordance with the laws of the Republic of Kenya. Any dispute, controversy, or claim arising out of or relating to these Terms shall be submitted to the exclusive jurisdiction of the courts of Kenya, specifically within the Nairobi jurisdiction. If any provision of these Terms is found invalid or unenforceable by a court of competent jurisdiction, such provision shall be modified or severed to the extent necessary to make it enforceable, without affecting the remaining provisions which shall continue in full force and effect.
